Against a Systemic Legal History
This paper questions a resort to systems theory as the foundation of an evolutionary legal history, which Marie Theres Foegen proposes. In particular, the theoretical legacy of Niklas Luhmann seems to have limited application outside a context in which advanced system differentiation is present. The great expansion advocated by Foegen to the domain of legal scholarship is also seen as problematic.
