In its judgment of 18 July 2005 (2 BvR 2236/04), the Second Senate of the German Federal Constitutional Court declared the German European Arrest Warrant Act (Europäisches Haftbefehlsgesetz) void. The act infringes Article 16.2 sentence 1 (ban on extradition) and Article 19.4 of the Basic Law (guarantee of recourse to a court). The press release of the court is given below.
