La contribution analyse les dispositions de la Directive Refonte relative aux conditions d’entrée et de séjour des ressortissants de pays tiers à des fins de recherche et d’études dans l’Union européenne, ainsi que les actes juridiques suisses réglementant le statut juridique des chercheurs et des étudiants des pays tiers en Suisse. Malgré des changements de la législation européenne et suisse, afin de mieux attirer « des cerveaux » et de renforcer l’innovation, il faut améliorer le statut juridique des chercheurs et des étudiants provenant de pays tiers en Europe. De même, il faut renforcer la coopération entre l’UE et la Suisse dans ce domaine.
