Les tribunaux associatifs et le Tribunal arbitral du sport (TAS) sont régulièrement confrontés à la question de la proportionalité des sanctions dans le cadre de procédures disciplinaires sportives. Dans les litiges relatifs au dopage, le code mondial antidopage de l'Agence mondiale antidopage (AMA) fixe un cadre juridique général pour le régime de sanctions applicable. Or il n'existe pas de cadre juridique comparable pour les litiges relatifs à la manipulation des compétitions sportives. La présente contribution analyse la jurisprudence du Tribunal arbitral du sport (TAS) dans le but de développer une ligne directrice pour un régime de sanctions harmonisé dans le domaine de la manipulation des compétitions sportives.
