Taking the practical example of international carriage of waste, including a section of the transport chain by rail we firstly explore the international contract of carriage by rail under COTIF 1999 and under the Basel Convention from 1989 and secondly examine the single legal provisions for waste carriage in the EU secondary law. We conclude that transport by rail is fundamental to the Europe circular economy and society as a whole, where proper recycling and transport of waste is an issue and a task for the European Green Deal policy.
