Will the European Patent Litigation Agreement (EPLA) be the solution to reach an harmonization of the European litigation system? This article describes, next to the historical background and the reasons that pushed the European Patent Organisation to the elaboration of such an agreement, the development of the situation in Europe in the field of patent litigation, putting a special accent on the relation of the EPLA to the project of the European Commission to create a Community Patent. In addition the impact of the last draft of the Hague Jurisdiction Agreement is also analyzed.
