Compliance with Public Law Requirements in the Buyer’s Jurisdiction as a Seller’s Obligation under Art. 35 CISG?

Bei einem internationalen Kaufvertrag kommt die Ware in Berührung mit zwei verschiedenen Rechtssystemen. Dabei stellt sich die Frage, welchen öffentlich-rechtlichen Vorgaben die Ware gemäss Art. 35 CISG zu entsprechen hat. Diese Frage musste bereits mehrfach von Gerichten entschieden werden, angefangen mit dem berühmten «Miesmuschelfall» des deutschen Bundesgerichtshofes vom 8. März 1995. Obwohl dieser Entscheidung gewisse Präjudizwirkung zugestanden wird, tendieren spätere Entscheidungen oftmals zu Käufer-freundlicheren Entscheiden. Das Ziel dieser Arbeit ist zu bestimmen, unter welchen Voraussetzungen ein Verkäufer verpflichtet sein soll, die Bestimmungen im Käuferland einzuhalten.
