Die Coronavirus-Pandemie befeuert eine Vielzahl vertragsrechtlicher Probleme. In diesem Aufsatz wird untersucht, welchen Beitrag allgemeine Rechtsinstitute – nachträgliche Unmöglichkeit, Verzugstatbestände, Anpassung an veränderte Umstände, Beendigung von Dauerschuldverhältnissen aus wichtigem Grund – zur Bewältigung der Pandemie leisten können und ob die Schweiz ein ausserordentliches Vertragsrecht in Zeiten der Pandemie braucht. Ausgehend von der zentralen Rolle der Vertragsparteien wird die zunehmende Aushöhlung des allgemeinen Rechtsgrundsatzes «pacta sunt servanda» durch die legislative, judikative und exekutive Staatsgewalt kritisch beurteilt.
