International data transfers and the EU’s adequacy decisions

A critical analysis of international data transfers between the European Union and the United States, the United Kingdom and Switzerland respectively, taking into account Article 45 GDPR, the Schrems judgements and Brexit

Das Schrems II Urteil des Europäischen Gerichtshofes vom 16. Juli 2020 fand weltweit Beachtung und warf unterschiedlichste, rechtliche Fragen auf. Eine davon betrifft die Frage der Angemessenheitsentscheidungen im Bereich des Datenschutzes, welche die EU-Kommission für Drittstaaten treffen kann. Im vorliegenden Beitrag analysieren die beiden Autorinnen die Einschätzung des Gerichtshofs zum Datenschutzniveau in den USA gemäss den Schrems Urteilen mit Blick auf die DSGVO und gehen sodann der Frage nach, wie die aktuelle Rechtsprechung die Angemessenheitsentscheidungen der Europäischen Kommission für das Vereinigte Königreich und die Schweiz beeinflussen könnte. Die Analyse erfolgt sowohl aus einem rein rechtlichen wie auch aus einem tatsächlichen, politischen Blickwinkel.
