On explicit request disciplinary proceedings against a lawyer have to be held in public hearings
The holding of court hearings in public constitutes a fundamental principle which represents one of the means whereby confidence in the courts can be maintained. In the case with a lawyer as applicant, neither the Supervisory Board nor the Federal Court had held public hearings in the context of the disciplinary proceedings against the applicant, despite his explicit request to that effect.
