Der vorliegende Beitrag bietet eine systematische Zusammenfassung der Rechtsprechung des Bundesgerichts («BGer») sowie des Europäischen Gerichtshofs für Menschenrechte («EGMR») im Bereich der nationalen und internationalen Schiedsgerichtsbarkeit für den Zeitraum vom 1. Januar 2023 bis zum 31. Dezember 2024. Im ersten Teil werden die einschlägigen Leitentscheide dargestellt, wobei jeweils der zugrunde liegende Sachverhalt, die Argumentation des BGer sowie eine kritische Würdigung aufgezeigt werden. Der zweite Teil vermittelt einen Gesamtüberblick über die Rechtsprechung des BGer zur nationalen und internationalen Schiedsgerichtsbarkeit, strukturiert nach den Beschwerdegründen von Art. 190 Abs. 2 IPRG und Art. 393 ZPO.
