Pour éviter autant que possible les tractations devant les tribunaux chinois, les parties étrangères se décident le plus souvent pour les tribunaux arbitraux. Des villes de la Chine ou de l’Etranger sont souvent convenues comme siège du tribunal arbitral, et en particulier la Région administrative spéciale de Hong Kong. Dans la rédaction de la clause arbitrale, il est important d’analyser l’impact du choix du siège sur la procédure et le droit matériel ; en effet, le choix du siège du tribunal arbitral peut avoir des conséquences sur l’exécution de sa décision.
