The COVID-19 pandemic is presenting challenges and opportunities to conduct virtual hearings before civil courts and before regulatory authorities, such as the Swiss Financial Market Supervisory Authority («FINMA»). This article analyzes the current legal situation in Switzerland, taking into account recent jurisprudence and developments in practice, and discusses some of the risks and opportunities of virtual hearings going forward.
